It depends on the nature of the bullying. Sometimes people will call and they'll say that they're being bullied just generically; their boss is generally being a jerk. And if that's all that's happening, if there isn't any discriminatory flavor to the bullying: racism, homophobia, sexism, then your remedies are somewhat limited under New Jersey law.
If the bullying is so severe and so bad that you have a true medical or psychiatric or psychological reaction to it, the Worker's Compensation laws provide a limited but real remedy. There is also a pending law proposed by Assemblywoman Greenstein that would create a workplace harassment and bullying law that compensates for bullying even though it's not necessarily flavored with the same context as a discrimination law prohibits bullying.
That law hasn't passed yet, but we support it because there are people that call us that unfortunately we can't offer a litigation option to that are being bullied, become sick as a result, and so far their only remedy under New Jersey law is Worker's Compensation.
