Special Needs:
A question I get a lot that's an important one is, "I have a special needs child. Is there anything I need to be concerned with". Well, yes, there are many things. When we're planning for a special needs child, we need to make sure that we don't provide for a direct inheritance from the parents. If you do, then any government assistance that they're getting, and that they're recieving because of financial need, they'll be disqualified for. They'll have to spend that inheritance down, and then re-qualify. There are special needs trusts that can be either incorporated in the will, or your revokable living trust or can be a seperate, completely different document. And it'll provide for the ability for your child to recieve an inheritance from you, but not get disqualified from special government assistance that they might be getting. And it's very important to make sure that you have all of that in writing, to provide for that special child.
