Small Auto Insurance Claims and Lawyer Fees

Attorney Brian McClain

Many potential clients are reluctant to call us when the insurance company has denied a bill for, let’s say, $150.00 or $200.00, because they’re concerned about how they’re gonna pay their lawyer to go after $120.00.  Well, with respect to personal injury protection claims, or bringing claims against your auto insurance carrier, if we prevail in proving that the insurance company breached its contractual obligations, or violated any Florida statutes pertaining to this subject matter, in addition to them having to pay that bill, they also have to pay for all attorney’s fees and costs.  The way we handle these matters is that if we do not prevail, there’s no charge to the client for either attorney’s fees or costs in prosecuting their claim against their insurance company.
