In New Jersey, sentencing largely is tied to the degree of offense that the individual is charged or ultimately convicted of. There’s forth degree offense. There’s third degree offense. There’s second degree offenses and first degree offenses. First degree being the most serious. Forth degree being the least serious. When I’m speaking of degrees, I’m speaking of indictable offenses that would be handled at the county level. And the sentencing guidelines are tied to the degree of offense, as well as the person’s prior criminal record.
