Warrentless Search
What are the most frequent issues that arise in my criminal practice is the issue of warrantless searches. Typically, they involve cars, setting some cases homes or other properties. The question there becomes, what basis did the police officers have for searching a vehicle or searching a home? Was that reasonable basis under the law? The issue of a terry search comes in, that’s technical term to describe the officer’s ability to sweep a scene to see if there is weapons. A lot of times an officer will expand on that and search things that may be he shouldn’t have. It’s important that you consult an attorney to see if the warrentless search was outside the constitutional parameters which would be permitted and that’s frequently a photo ground for defending a person.
