Frequently, clients will come into our office who were injured in an accident, such as an auto accident or a slip and fall, where they were previously injured in the same spot. This is called a preexisting condition by an insurance company, either by the health insurance company, auto or whomever. The insurance company will try and use this as a way to escape responsibility for compensation for your injuries.
The insurance company is required by law to take you as you are. Meaning that even if you suffered from a preexisting condition, such as your clavicle being broken or a torn rotator cuff or what have you and that same injury happens again or you're injured in the same spot, then it’s required for them to take responsibility and pay for compensation for your injuries.
The argument of the insurance company will be that you were already injured in this particular spot, and, therefore, they shouldn't be responsible for paying for your injuries. This is simply not true.
