Hi, I’m Cincinnati motorcycle attorney Anthony Castelli. My message today is don't feel like the insurance company has an advantage against you in the state of Ohio because you did not wear a helmet. I just took my helmet off. I prefer to wear a helmet.
In Ohio, you’ve got a choice, at least if you’ve been riding for more than one year. The only requirement is for a helmet in Ohio is if you have not ridden for one year or you're on a bike with someone who has not ridden for a full year.
And the statute says that the fact that you don't have a helmet on is not admissible in evidence. Now, the insurance company is going to tell you if you don't have a helmet on, that you should have your compensation lessened. That's why you need to get a good motorcycle accident attorney on your side who knows the law, who knows how to keep out evidence that should never come into your case and should never be considered.
Think about it. When you're driving down the road and somebody turns in front of you because they weren't paying attention, why should the fact that you had or didn't have a motorcycle helmet on come into play?
So don't believe the myth that no helmet, no compensation. That's not true in the state of Ohio. And believe me, I will defend your right not to wear a helmet. Though I may have a different idea about helmets than you, the fact is that, in the state of Ohio, you don't have to wear a helmet and you should not be penalized if you don't have one on, when you’re in an accident.
