No-Fault Car Insurance: Legal Definition

Attorney Michael Krutman

A lot of people will say to me that New -- what does no fault mean because New Jersey happens to be a no fault state. What that means is when you’re injured in an automobile accident, doesn’t matter whose fault it is, if you’re injured in an accident your own auto insurance company is responsible for the payment of your medical bills minus a co-pay and a deductible.

So if you’re injured in an accident and it’s the fault of the other driver what you can recover from the other driver’s insurance is compensation for pain and suffering. But payment of medical bills are covered by your own auto insurance. They are responsible for the payment of your medical bills because we are a no fault state.
