The prevailing wage act is a statute in New Jersey that is designed to address the amount of wages that employees earn when their performing work for employers, even private employers that are doing work either by contract with a public entity or funded by public funds.
The act defines these generally as public works. If you are working on a public work even for a private employer every county in New Jersey has a separate prevailing wage act determination that will set forth the hourly rate and the over time rate that employees in various classifications are entitled to receive.
If you are not receiving the wages that the county has set for you, you have the right through the prevailing wage act to file a law suit on behalf of yourself and other employees who are also being denied those wages to receive the difference between the amount that your employer is paying you and the amount that your employer is supposed to be paying you under the act.
