DWI cases in New Jersey are prohibited from plea bargaining meaning you’re not permitted to plea bargain cases, there’s decisions, there’s edicts from the administrative office of the court.  So prosecutors aren’t allowed to just plea bargain a case like they could a routine traffic offense.

So what does that mean for an individual charged with DWI?  It means it’s of paramount importance that they hire an attorney because only with an attorney can they present issues that can give a prosecutor genuine basis to down grade the charge.  You’re only going to be able to present those issues if you hire an attorney and that’s why it’s of so much importance that you do hire an attorney if you are charged with DWI.
