NJ DUI: License Suspension

Attorney John Marshall

The license suspension for a conviction of a DWI or DUI in New Jersey depends on what offense it is.  Is it a first offense, second offense or third offense?

Let’s talk about a first offense.  In New Jersey we now have a tiered statute.  What I mean by tiered is this, the suspension is tiered.  If you are convicted based on a blood alcohol level content of 0.08 up to 0.10 you’re going to be subject generally to a three month suspension of your license.

If however the blood alcohol level content was 0.10 or higher you’re going to be subject to a licenses suspension of seven months to a year.  On a second offense there’s no tiering, it’s two years loss of a license.  On a third offense is 10 year loss of license.  It’s important that you hire an attorney, these are talking about a significant impact on your life and you really need to have an attorney at your side.
