New Jersey as I’ve said before is one of the most progressive states in the country and we have this wonderful law the New Jersey Law Against Discrimination. Which offers the same protection almost universally as the federal law does, now in some states, many states in fact there is no discrimination law. So the only game in town are the Federal laws, of course they apply in all 50 states.
So what I often get calls on are people calling me thinking when they talk about disability that they have rights under the Americans with Disabilities Act or the ADA because that’s what they hear about most often. But electing to pursue rights under the ADA would be like electing to drive a Buick instead of a Cadillac.
The New Jersey LAD is more extensive; more liberally interpreted, contains more in it to protect people and offers far more in the way of rights and remedies than the ADA does. So unless I’ve got a Federal defendant, which compels me to use the Americans with Disabilities Act, I will always choose the New Jersey Law Against Discrimination to advance disability rights.
