Montana law requires that medical bills be paid and lost wages be paid and other related expenses for a client if what is called liability is reasonable clear. Meaning if it’s reasonable clear that the other person was at fault, such as the other person ran the red light and them running the red light caused your injuries, then the insurance company is required to pay for your medical bills and your lost wages and for other related expenses.
Insurance companies will frequently say that your medical expenses were caused by something else, something other than the auto accident, or that the injuries that you suffered were not related to the auto accident. Unfortunately, in many cases, we have to file suit to get the insurance company to take responsibility for paying for your medical expenses and for lost wages.
