Clients will sometimes ask me what about mediation, what about arbitration. Mediation is a process whereby a mediator, usually someone who knows this area of the law, sometimes a retired judge tries to make peace between the parties.
And that basically means that they try to reach consensus. They try to find if money damages are sought a number that will satisfy the plaintiff and that the defendants will pay. Mediation is something that we encourage because these cases can be very long, they can be very time consuming, they can be very expensive. And if both parties are in a mood to settle early, mediation usually accomplishes that pretty well.
The state court system has a very good mediation program and when it doesn’t serve we don’t’ hesitate to go to retired judges to do that. Of course if mediation doesn’t work then we prepare for war and we go to trial for you.
