We call equitable damages equitable because it’s from a concept of fairness. If you’ve been discriminated against and you should have been hired for the job but you didn’t get it because you are a woman or because you’re Black or because you’re Jewish and you find that you continue to be out of work for a time until you get that replacement job; you’ve lost money.
And equitable damages are what we call sometimes back pay or front pay. Sometimes equitable damages include the value of lost benefits like health insurance, 401k contributions, pension contributions or other benefits.
