Insurance Claims: Bad Faith

Bad faith occurs when an insurance claim is wrongfully denied by the insurance company.  To prove bad faith you must establish that the insurance company failed to honor the contract and had no cause not to pay what was due.  There are many examples of how an insurance company can commit bad faith, including failing to promptly and thoroughly investigate a claim, unreasonably delaying payment, unreasonably denying benefits to a claim, using unreasonable interpretations in translating policy language, or refusing to settle the case or reimburse you for the entirety of your loss.
