We frequently get calls from people who have slipped and fell in a grocery store and want to find out if they have a claim. Let’s say, for example, that you’re in the produce section of the grocery store and there's something on the floor and you have fallen on the floor, because of water or a grape or whatever it was that was on the floor.
The answer to this question is what we call notice. Did the grocery store have notice that there was a problem and should have fixed it before you were injured? Was the problem there for minutes or hours or whatever and people complained about the problem and the grocery store ignored it, didn't do anything about it and just left it as is?
If that is the case and the grocery store just left it as is, then it’s likely that the grocery store is at fault. The grocery store has a duty, has a responsibility, to take care of problems such as that. If they don't take care of those problems, then you probably have a claim.
