Florida Overtime Laws and Citizenship

Attorney Richard Celler

Although some people believe that you have to be a citizen of the United States to file a claim for overtime or minimum wages under the Fair Labor Standards Act, this is not necessarily true.  For example, the law in Florida provides that even if an individual is not a citizen of the United States, he or she still is entitled to pursue a claim for unpaid overtime or minimum wage compensation under the FLSA.  Other states have similar laws as well to protect persons who are not necessarily citizens.
