Filing Divorce Applications

Attorney Bonny Reiss

People tend to be very focused on what they say in their complaint for divorce, but really the complaint for divorce is nothing other than the key that opens the courthouse door, and judges don’t look carefully at what the allegations in the complaint are.

The more important thing are applications that are filed with the court during the pendency of the case. For example, if you don’t have enough money to meet your expenses we will sit with you and we will file something called a motion for temporary or pendente lite support.

The motion is essentially a list of what you’re asking the judge to give you and the certification tells the judge why you want it, and that’s our opportunity with you to present to the judge the kind of lifestyle that you and your family lived.

We take pride in the papers that we file with the court. We try to get the judge to know you and how you and your family spent your money, what was important to you, your educational priorities, where you shopped, where you went on vacation, and we try to do it in a way where the writing is interesting and creative enough to keep the judge interested. Essentially our job is to market you to the court and we work very hard to do that, and we’ve been told time and again by judges and law clerks that we provide papers to the court that are exceptional, and that is one of the things that we take pride in offering to our clients.
