Examples of Negligent Conduct

Attorney Michael Shepard

Negligent injuries in nursing homes and rehabilitation centers occur when a staff member or other employee of the nursing home does something by virtue of an omission as opposed to an act that causes injury.  So an example would be not paying attention and not monitoring a patient so that if they have a medical emergency going on, if there is no one keeping an eye on that patient, they could be having a heart attack or a stroke and you would never know it because there is nobody paying attention.

Things like falls happen where patients get up out of bed or roll out of bed because there are improper safety precautions being taken at the nursing home or the rehabilitation facility.  There is such a thing called elopement where a patient actually physically gets up and walks right out the front door and no one is paying attention to either stop the patient or to monitor the patient to find out where they are at all times or where they are going, or alarms on the door to prevent them from just escaping out the back door.

There are also negligent injuries involved with nutrition.  If a patient has difficulty feeding themselves or has specific nutritional needs and it is not being met by the nursing home or they are not monitoring that the patient has not finished their meal or did not eat their meal and that has gone on for several days, you may find that a patient is malnourished, is dehydrated and injuries result from that way.

And then there are also injuries from decubitus ulcers, bed sores, which are one of the most common and that is usually due to a nursing home not having enough staff or not taking enough time to move the patient around in bed.  If you lie in one spot for too long, you are going to be susceptible to a bed sore and they can be very painful and very difficult to get rid of and ultimately are the fault of negligence within the nursing home or the rehabilitation center.
