Employer Retaliation Under the FLSA

If you file a lawsuit under Fair Labor Standards Act, the law protects you from retaliation.  An employer who retaliates or discriminates against an employee for filing a lawsuit is in violation of the law, and is subject to fines or even criminal prosecution.  The affected employee is entitled to legal or equitable relief, including, without limitation, employment reinstatement, promotion, and a payment of lost wages in an additional equal amount.  Plus, attorney’s fees and court costs.  Punitive damages are also available in appropriate cases, and anti-retaliation cases may be brought against individuals as well as their employers.
