I’m often asked about the concept of mediation, and sometimes even about arbitration. These are two concepts that are becoming more popular in resolving divorce cases. Mediation is where one hires a third party who acts as a mediator who helps – who tries to help the parties along with their attorneys to reach an agreement. An arbitrator is also a third party hired by the parties, but the arbitrator hears the positions of both parties and their lawyers and makes a decision for them. So in one instance, mediation, you have a settlement that’s facilitated by a third party. In the other instance, you have a decision made by a third party.
