In our increasingly mobile society we’re often confronted with cases in which one parent wants to move out of New Jersey with the children. New Jersey statutes require that in those situations that parent either get the consent of the other parent or obtain a court order. If the noncustodial parent will not consent, an application has to be made to the court and a full hearing has to take place to determine whether there is a legitimate basis for the request and how that will impact the children’s relationship with the spouse that isn’t moving.
