One of the many categories that you are protected for against harassment and discrimination in our state, we talked about age and gender and ethnicity and many categories is also disability or perception of disability or handicap.
So what that means is any serious health condition, even if it’s temporary is liberally treated by our law against discrimination as either a disability or handicap. And you are protected against any retaliation, discrimination or harassment just because you are handicap or disabled. But more importantly our law against discrimination protects against perception of disability or handicap.
So that if you are being harassed or discriminated against because your boss has particular ideas about what your illness means for him that’s illegal. If your boss is discriminating against you because he thinks you have an illness you don’t’ have that’s illegal. If your boss thinks that you’re in possession of certain characteristics or limitations because he traditionally associates those with the kind of illness or disability that you have and you don’t, that’s illegal.
