Unfortunately, many of our clients who have been in auto accidents have suffered from traumatic brain injuries. They frequently don't know that they’ve suffered from a traumatic brain injury, because they don't know what the symptoms are or no one brings these symptoms to their attention.
The most fret and common symptoms of a traumatic brain injury are loss of memory, either short-term or long-term memory, loss of concentration and difficulty sleeping. There are many other factors that may be indicative of a traumatic brain injury.
Even someone who is riding in a car and is wearing their seatbelt and the airbag or airbags deploy in a car can suffer from a traumatic brain injury. Simply the impact from another vehicle hitting their car can cause a traumatic brain injury.
One of our clients was in a seemingly minor auto accident. She displayed symptoms of a traumatic brain injury that we readily recognized, because we are experienced in these. We referred her to a doctor who was able to evaluate her for traumatic brain injury and then he gave us back a report saying that he believed that she suffered from a traumatic brain injury.
Fortunately, the client in this case expressed the symptoms that she was experiencing and that she hadn’t experienced before the auto accident that was indicative of a traumatic brain injury.
What will happen in cases when someone has a traumatic brain injury is the insurance company will frequently say that your client has been in sports and had concussions from sports, they’ve been other auto accidents, which they believe caused their traumatic brain injury, or a slip and fall where they hit their head. And they will point to these things to try and get out of responsibility for a traumatic brain injury.
