Appealing Social Security Disability Claims

You have the right to appeal any decision the Social Security Administration makes in regards to your eligibility for disability insurance benefits, or Supplemental Security Income payments.  If you choose to appeal, a written request must be submitted within sixty days from the day you receive the letter of denial. 

During an appeal, the Social Security Administration will review the initial decision, even the sections that were in your favor.  If any material mistakes were made, the decision can be reversed.

There are four levels of appeal.  Reconsideration, a hearing before an administrative law judge, appeals council review, and Federal court review.
